Terms of Service

Welcome to Calorie AI. These Terms of Service ("Terms") govern your access to and use of the Calorie AI iOS application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or 16 in the EU/UK) to use the App. By using the App you confirm that you meet this requirement.

2. Your Account

You sign in using Apple ID or Google. You are responsible for maintaining the confidentiality of your account and for all activity under it. Notify us immediately if you suspect unauthorized access. The App enforces a single active session — signing in on a new device will sign you out on previous ones.

3. Subscriptions and Payments

3.1 Free and Premium tiers

The App offers a free tier with a limited daily number of AI food scans, and a Premium subscription that unlocks unlimited scans, AI-generated diet plans, and AI chat-based plan editing.

3.2 Auto-renewal

Premium subscriptions are billed through your Apple App Store account and renew automatically at the end of each subscription period unless cancelled at least 24 hours before the renewal date. The renewal price equals the original purchase price unless we notify you of a change.

3.3 Managing your subscription

You can view, change, or cancel your subscription anytime in iOS Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current billing period.

3.4 Refunds

All subscription payments are processed by Apple and are subject to Apple's standard refund policy. Request refunds via reportaproblem.apple.com. We cannot issue refunds directly.

4. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the App
• Bypass the App's authentication, scan-quota, or subscription mechanisms
• Use the App to upload illegal, abusive, or copyrighted content you don't own
• Impersonate another person or use the App on behalf of someone without authorization
• Stress-test, scrape, or otherwise abuse our backend infrastructure
• Use the App for any illegal purpose or in violation of any applicable law

5. AI-Generated Content

The App uses AI to identify food items, look up nutrition data, and generate diet plans. AI is imperfect:

• Identified ingredients and nutrition values are estimates, not exact measurements.
• Generated diet plans are general suggestions, not personalized medical advice.
• You are responsible for verifying any nutrition information that matters to your health.

6. Health Disclaimer

Calorie AI is not a medical device or a substitute for professional medical advice. The information shown — calorie targets, macros, diet plans, activity readings — is for general informational and educational purposes only. Consult a qualified healthcare provider before making dietary changes, especially if you have a medical condition, are pregnant, are an athlete with specific nutritional needs, or are recovering from an eating disorder.

7. Intellectual Property

All content, branding, and code in the App are owned by us or our licensors. You retain ownership of the photos and content you provide; you grant us a limited license to process that content as needed to provide the service (e.g., sending a meal photo to a vision AI for analysis).

8. Termination

We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that harms us, other users, or our service providers. You may stop using the App at any time and delete your account in-app or via our Support page.

9. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Calorie AI and its operators shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of (or inability to use) the App, including but not limited to loss of data, loss of profits, or health-related outcomes. Our total liability in any matter shall not exceed the amount you paid us in the twelve months preceding the claim, or USD $50, whichever is greater.

11. Changes to These Terms

We may update these Terms as the App evolves. Material changes will be communicated in-app or by email. Continued use after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to its conflict-of-law principles. Any dispute will be resolved in the courts located in that jurisdiction.
